The U.S. Judicial Panel on Multidistrict Litigation (JPML) held a December 1, 2011 hearing and subsequently decided to consolidate the federal court Actos lawsuits into multidistrict litigation (MDL). This means that Actos lawsuits filed in federal courts across the country will all now be heard in one court, however with each retaining its own individual status.
The JPML consolidated the Actos litigation in front of Judge Rebecca Doherty of the Western District of Louisiana. The consolidation brings all federal court Actos bladder cancer lawsuits into one court, where pre-trial proceedings will be more efficient and cost effective.
Judge Doherty has held the first court hearing of the federal court Actos lawsuits on March 22, 2012 in Lafayette, Louisiana and appointed the plaintiffs steering committee to assist with running the MDL.
Increasing Number of Actos Bladder Cancer Lawsuits
The number of Actos lawsuits filed across the country has steadily increased as more people become aware of the connection between the diabetes drug and bladder cancer. The Actos bladder cancer lawsuits allege that Takeda failed to adequately warn about the risk of the disease. The FDA also recently issued a public health statement concerning Actos and bladder cancer, partly in response to the increasing number of plaintiffs choosing to file lawsuits.
The Actos MDL differs from an Actos class action lawsuit. In a class action lawsuit, the class action plaintiffs represent all those involved who were injured. The Actos MDL retains the individual and distinct case for each of the Actos bladder cancer lawsuits, and could potentially result in higher individual Actos settlements.
